This is by far my favorite topic and that is anything that infringes on our Constitution and Bill of Rights.
I tell you this, there is no other Amendment as important as the 2nd.
Amendment. This Amendment upholds and secures all the other rights that
grant us Freedom and Liberty. It was put in the Bill of Rights to
protect "We the People" from a any tyranny force that acted like King
George III in whom they faced under extreme injustice in the beginnings
of These United States of America.
Amendment II
"A well regulated militia, being necessary to the security of a free
state, the right of the people to keep and bear arms, shall not be
infringed."
This one sentence so simple and pure in it's content, has been one of the most abused rights we have.
The word Infringed was placed as a binding clause at the end of this
Amendment, because, the men who drafted the Constitution and Bill of
Rights were far more educated than the common man, who were mainly
farmers in our early history. They knew they would have to write in the
simplest of terms so all men could understand these Rights.Lets go back
to the word "infringe" since it's a binding clause."Shall not be
infringed" "Shall not be" means simply "Never".
While, Infringed 1.) Actively break the terms of (a law, agreement,
etc.): "infringe a copyright". 2.) Act so as to limit or undermine
(something); encroach on: "infringe on his privacy".( Websters
Dictionary.) Here we are mainly looking at the second definition
although both hold true. Any gun law by the terms of Constitution are
simply Unconstitutional. Wait? But congress can change Amendments and
the law! Yes,they can on most but looking at the first definition of
"infringed" 1.) Actively break the terms of (a law, agreement, etc.):
"infringe a copyright". "Actively" is a action word infringed nullifies
the action due to the act of limiting or under minding of this right.
"And that the said Constitution be never construed to authorize Congress
to infringe the just liberty of the Press, or the rights of Conscience;
or to prevent the people of the United States, who are peaceable
citizens, from keeping their own arms; …"
Samuel Adams
quoted in the Philadelphia Independent Gazetteer, August 20, 1789, "Propositions submitted to the Convention of this State"
The Dick Act of 1902 also known as the Efficiency of Militia Bill
H.R. 11654, of June 28, 1902 invalidates all so-called gun-control laws.
It also divides the militia into three distinct and separate entities.
The three classes H.R. 11654 provides for are the organized militia,
henceforth known as the National Guard of the State, Territory and
District of Columbia, the unorganized militia and the regular army.
The militia encompasses every able-bodied male between the ages of 18 and
45. All members of the unorganized militia have the absolute personal
right and 2nd Amendment right to keep and bear arms of any type, and as
many as they can afford to buy.
The Dick Act of 1902 cannot be repealed; to do so would violate bills of
attainder and ex post facto laws which would be yet another gross
violation of the U.S. Constitution and the Bill of Rights.
The President of the United States has zero authority without violating
the Constitution to call the National Guard to serve outside of their
State borders.
"A
well regulated militia, being necessary to the security of a free
state, the right of the people to keep and bear arms,( shall not be
infringed.") Shall not be infringed is a protective clause. Shall not
be=NEVER Infringed =1.) Actively break the terms
of (a law, agreement, etc.): "infringe a copyright". 2.) Act so as to
limit or undermine (something); encroach on: "infringe on his
privacy".If this is the case then all attempts of a gun ban or control
are Unconstitutional and The Bill of Rights is a signed binding document
of the first acts of Congress and Senate.
"I ask, Sir, what is the militia? It is the whole people. To disarm the
people is the best and most effectual way to enslave them."
George Mason
Co-author of the Second Amendment
during Virginia's Convention to Ratify the Constitution, 1788
Why do we want to have Semi Automatics weapons? This is simple, any
tyrant force that would threaten us have automatic weapons! The passing
of the NDAA and Patriot Act, has put the 4th,5th, and 6th Amendments
into extreme jeopardy. If we loose our 2nd Amendment we as a people will
have no means of ensuring to ourselves these rights granted to us by
The Constitution's Bill of Rights. So for all that oppose any of the 2nd
Amendment you really need to consider all your other Rights you will be
throwing away or risking. Without our defense against tyranny the 2nd.
Amendment, we will subdue to our own demise.
"The supposed quietude of a good man allures the ruffian; while on the
other hand arms, like laws, discourage and keep the invader and
plunderer in awe, and preserve order in the world as property. The same
balance would be preserved were all the world destitute of arms, for all
would be alike; but since some will not, others dare not lay them aside
… Horrid mischief would ensue were the law-abiding deprived of the use
of them."
Thomas Paine
"To preserve liberty, it is essential that the whole body of the people
always possess arms and be taught alike, especially when young, how to
use them."
Richard Henry Lee
American Statesman, 1788
This fact remains Evil men do Evil things all the gun control or bans simply make us victim's to a more extreme..
